Service Description
North Carolina Pest Control provides professional pest management and extermination services for residential and commercial properties throughout the state of North Carolina. Our services include, but are not limited to, inspection and identification of pest infestations, treatment and control of common household pests such as ants, termites, rodents, cockroaches, spiders, bed bugs, mosquitoes, and other wildlife; preventative maintenance programs; and consultation on integrated pest management solutions. Specific treatment methods, frequency of service visits, and covered pest types are determined based on individual property assessments and the service agreement entered into between North Carolina Pest Control and the client. All services are performed by licensed technicians in accordance with applicable North Carolina regulations and industry standards. We reserve the right to modify our service offerings, treatment protocols, and pricing structures at any time with reasonable notice to existing clients.
No Guarantee or Warranty
While North Carolina Pest Control strives to deliver effective pest management solutions, we do not guarantee complete or permanent eradication of all pests from any property. Pest control results depend on numerous factors beyond our reasonable control, including but not limited to: environmental conditions, neighboring property infestations, structural integrity of buildings, client adherence to recommended sanitation and exclusion practices, weather patterns, and pest biology and behavior. We make no express or implied warranties regarding the outcome of any treatment, including merchantability or fitness for a particular purpose. Any written service agreement warranties are limited to the specific terms contained therein and do not extend beyond the scope and duration explicitly stated. Recurring pest activity does not necessarily indicate service failure and may require additional or alternative treatment approaches at additional cost.
User Responsibilities
Clients engaging North Carolina Pest Control services bear several important responsibilities to ensure treatment effectiveness and safety. You must provide accurate and complete information regarding property conditions, known pest issues, previous treatments, presence of children or pets, and any health sensitivities of occupants. You are responsible for preparing your property as instructed prior to service visits, which may include removing food items, securing pets, clearing access to treatment areas, and following post-treatment instructions. You must not interfere with, disturb, or remove treatment applications, bait stations, or monitoring devices without our prior authorization. You agree to maintain reasonable sanitation standards and implement recommended exclusion measures, such as sealing entry points and addressing moisture issues. Failure to fulfill these responsibilities may void any service guarantees, reduce treatment effectiveness, and result in additional service charges. You must promptly notify us of any adverse reactions, persistent pest activity, or property damage concerns following treatment.
Limitation of Liability
To the maximum extent permitted by applicable law, North Carolina Pest Control's total liability arising from or relating to our services, whether in contract, tort, strict liability, or otherwise, shall not exceed the total amount paid by you for the specific service giving rise to the claim during the twelve (12) months preceding the event. We shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of use, business interruption, or personal injury beyond that covered by our general liability insurance, regardless of whether such damages were foreseeable or whether we were advised of the possibility thereof. This limitation applies even if any limited remedy fails of its essential purpose. We are not responsible for damage to personal property, landscaping, or structures that results from pre-existing conditions, failure to follow our instructions, or circumstances outside our reasonable control. Our liability for damage to real or personal property directly caused by our negligence is limited to the cost of repair or replacement, not to exceed the service fee paid.
Intellectual Property
All content, materials, and intellectual property associated with North Carolina Pest Control, including but not limited to our company name, logos, service marks, trade dress, website content, photographs, treatment protocols, technical documentation, customer databases, and proprietary methodologies, are the exclusive property of North Carolina Pest Control or our licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws. You are granted no license or right to use any of our intellectual property without our prior written consent. Any feedback, suggestions, or ideas you provide regarding our services may be used by us without compensation or attribution. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our intellectual property without express written authorization. Unauthorized use may result in civil and criminal penalties under applicable law.
Governing Law
These Terms of Service and any disputes arising from or relating to our services shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or related to these terms or our services shall be instituted exclusively in the state or federal courts located in Wake County, North Carolina, or such other county in North Carolina where our principal place of business is located. You irrevocably submit to the jurisdiction of such courts and waive any objection to venue or inconvenient forum. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If any provision of these terms is held invalid or unenforceable under North Carolina law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
Changes to Terms
North Carolina Pest Control reserves the right to modify, amend, or update these Terms of Service at any time and for any reason at our sole discretion. Changes will become effective immediately upon posting to our website or other notice methods, with the "Last updated" date revised accordingly. Material changes affecting existing service agreements will be communicated to active clients through the contact information on file, and such changes will become effective thirty (30) days from the date of notice unless a shorter period is required by law or circumstances. Your continued use of our services after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically. If you do not agree to the modified terms, you must discontinue using our services and notify us to terminate any active service agreement in accordance with its termination provisions. No oral modifications or waivers of these terms shall be binding.
